How the agent-based O-1 works

Most people assume an O-1 needs one U.S. employer willing to file. It does not have to. A U.S. agent can petition for work across several employers, which suits athletes, artists, founders, researchers and specialists with more than one engagement.

The three things every O-1 needs

  1. Evidence of extraordinary ability or achievementUsually at least three of the criteria for your field: awards, press, judging others' work, original contributions, scholarly articles, a critical role, high pay, or selective memberships (O-1A); lead roles, reviews, success and recognition (O-1B).
  2. Work in the U.S. to doAn itinerary of real engagements, such as roles, contracts, events or gigs, with the agreements behind them.
  3. A U.S. petitionerAn employer, or an agent filing for work with several employers.

How the agent-based O-1 works, from law firms

You do not need a single employer to file for you. A U.S. agent can petition for work with several employers. These explainers come from law firms, including ours, and from the regulation itself:

Track record behind the method

Built by the litigators who pioneered the O-1 agent-based process at the highest levels of pro sports and entertainment. The founding attorney's team won First Round Management v. USCIS — landmark case that rewrote P-1 policy for unsigned athletes.

Common questions

Can I file my own O-1?

No. Someone in the U.S. has to file the petition: a U.S. employer, or a U.S. agent.

What does an agent do?

A U.S. agent can file one petition covering work with several employers, backed by an itinerary of the engagements and the agreements behind them. The work you may do is the work the approved petition describes.

Do the employers have to file anything?

In an agent-based case the employers do not file the petition and do not pay the USCIS filing fee. They sign letters or engagement terms that describe the work.

What does O1DMatch do here?

O1DMatch helps you build the evidence, meet U.S. companies that post roles and gigs, and assemble the itinerary. When your case is ready, an immigration attorney takes it the rest of the way. O1D Match LLC is not a law firm.
